Virginia Cannabis Laws and Regulations

Both medical and adult-use (recreational) cannabis are legal in Virginia. The medical cannabis program was established in 2017 and became operational in 2020. Adult-use cannabis was legalized in 2021, with retail sales expected to begin in the future.

Medical Marijuana Card Process

Step 1

Obtain a certification from a registered practitioner.

Medical Eligibility & Consultation Options

  • Virginia allows registered practitioners to certify patients for medical cannabis use for any condition that the practitioner believes can be treated with cannabis.
  • Virginia allows telemedicine for medical cannabis consultations, including for initial certifications and renewals.

Register with the Virginia Board of Pharmacy.

Step 3

Pay the application fee and submit required documentation.

  • Await approval (processing time typically 7-10 business days)
  • Obtain a new certification from a registered practitioner
  • Submit a renewal application online
  • Pay the renewal fee ($50 as of 2024)
  • Renew annually
