Florida Cannabis Laws and Regulations

Medical cannabis is legal in Florida. The state's medical marijuana program was established in 2016 with the passage of the Florida Medical Marijuana Legalization Initiative (Amendment 2). Adult-use (recreational) cannabis remains illegal.

Medical Marijuana Card Process

Step 1

Obtain a certification from a qualified physician registered with the Florida Office of Medical Marijuana Use (OMMU).

  • Cancer
  • Epilepsy
  • Glaucoma
  • HIV/AIDS
  • Post-traumatic stress disorder (PTSD)
  • Amyotrophic lateral sclerosis (ALS)
  • Crohn's disease
  • Parkinson's disease
  • Multiple sclerosis (MS)
  • Medical conditions of the same kind or class as or comparable to those above
  • Chronic nonmalignant pain caused by a qualifying medical condition
  • Terminal conditions diagnosed by a physician other than the qualified physician issuing the certification
  • Florida does not allow telemedicine for initial medical cannabis consultations. All initial consultations must be conducted in person. For follow up consultations, patients may use telemedicine to see their established cannabis doctor.

Step 2

Register with the Florida Medical Marijuana Use Registry.

  • Proof of Florida residency (driver's license, state ID, or utility bill)
  • Passport-style photograph
  • Application fee ($75)

Step 3

Apply for a Medical Marijuana Use Registry Identification Card.

  • Visit the Florida Medical Marijuana Use Registry website
  • Complete the online application
  • Upload required documents
  • Pay the application fee
  • Await approval (processing time varies). Typically, same day approvals are common assuming there are no issues.

Step 4

Pay the application fee and submit required documentation.

  • Obtain a new certification from a qualified physician (required at least once every 30 weeks)
  • Submit a renewal application online
  • Pay the renewal fee ($75)
  • Renew annually
