Delaware Cannabis Laws and Regulations

Both medical and adult-use (recreational) cannabis are legal in Delaware. Medical marijuana was legalized in 2011 with the Delaware Medical Marijuana Act. Adult-use cannabis was legalized in April 2023, but the regulatory framework for sales is still being developed.

Obtain a certification from a qualified physician.

Muscular dystrophy
And several other conditions

Delaware allows telemedicine for medical cannabis consultations, including renewals. The initial consultation must be in person.

Register with the Delaware Medical Marijuana Program.

Step 3

Pay the application fee and submit required documentation.

Valid Delaware driver's license or state ID
Proof of residency
Physician certification
Application fee ($50 for standard card, $20 for low-income patients)

Visit the Delaware Medical Marijuana Program website
Complete the online application
Upload required documents, including physician certification
Pay the application fee
Await approval (usually within 10-15 business days)

Obtain a new certification from a qualified physician
Submit a renewal application online
Pay the renewal fee ($50 or $20 for low-income patients)
Renew annually
