Delaware Cannabis Laws and Regulations

Both medical and adult-use (recreational) cannabis are legal in Delaware. Medical marijuana was legalized in 2011 with the Delaware Medical Marijuana Act. Adult-use cannabis was legalized in April 2023, but the regulatory framework for sales is still being developed.

Medical Marijuana Card Process

Obtain a certification from a qualified physician.

  • Cancer
  • Terminal illness
  • Positive status for HIV
  • AIDS
  • Decompensated cirrhosis
  • Amyotrophic Lateral Sclerosis (ALS)
  • Agitation of Alzheimer's disease
  • Post-traumatic Stress Disorder (PTSD)
  • Autism with self-injurious or aggressive behavior
  • Glaucoma
  • Chronic debilitating migraines
  • Intractable epilepsy
  • Seizure disorder
  • Neuropathy
  • Muscular dystrophy
  • And several other conditions
  • Delaware allows telemedicine for medical cannabis consultations, including renewals. The initial consultation must be in person.

Step 2

Register with the Delaware Medical Marijuana Program.

Step 3

Pay the application fee and submit required documentation.

  • Valid Delaware driver's license or state ID
  • Proof of residency
  • Physician certification
  • Application fee ($50 for standard card, $20 for low-income patients)
  • Visit the Delaware Medical Marijuana Program website
  • Complete the online application
  • Upload required documents, including physician certification
  • Pay the application fee
  • Await approval (usually within 10-15 business days)
  • Obtain a new certification from a qualified physician
  • Submit a renewal application online
  • Pay the renewal fee ($50 or $20 for low-income patients)
  • Renew annually
